END USER LICENCE AGREEMENT (EULA)

This End User Licence Agreement (“EULA”) is a legal agreement between you and SURVIVAL GAMES LTD concerning your installation and use of our Games.

Please read this EULA carefully. By downloading, installing, accessing or using a Game, you agree to this EULA. If you do not agree, do not download, install or use the Game.

1. About us

SURVIVAL GAMES LTD (“Survival Games”, “we”, “us” or “our”) is a company registered in England and Wales under company number 12243817.

2. Games covered by this EULA

This EULA applies to the following mobile games, including their updates, renamed versions and successor versions:

Raft® Survival - Ocean Nomad;
Raft® Survival : Desert Nomad;
Raft® Survival: Multiplayer;
Raft® Survival Adventure Quest;
Raft® Survival: Sandbox Game;
Let’s Survive - Survival games;
Dead.io - Zombie Survival Game;
Grand Sniper: 3D Shooting Game; and
Survival Stories: Novel Games.

Together, these are referred to as the “Games”.

Additional conditions presented inside a Game, on a purchase screen or by the platform through which you obtained the Game may also apply.

3. Relationship with other terms

Our Terms of Use govern player conduct, multiplayer features, purchases, subscriptions, virtual items, refunds, Player Content and dispute resolution.

Our Privacy Policy explains how personal data is processed when you use the Games.

This EULA governs the licence to install and use the Games. If there is a conflict:

mandatory law takes priority;
applicable Apple App Store, Google Play or other platform terms take priority to the extent required for use of that platform;
this EULA takes priority for licensing matters; and
the Terms of Use apply to other aspects of the Games and related services.

4. Eligibility and minors

The Games are general-audience products and are not directed to children under 13.

If you are below the age of legal majority where you live, you may use a Game only with the involvement and permission of a parent or legal guardian. Your parent or guardian should review this EULA and the Terms of Use with you.

A higher minimum age may apply to a particular feature, multiplayer service, transaction or jurisdiction. Store age ratings describe the suitability of game content and do not necessarily represent the minimum age for entering into a binding contract.

Parents and guardians are responsible for supervising minors’ use of the Games, purchases and applicable device or platform parental controls.

5. Licence grant

Subject to your compliance with this EULA, the Terms of Use and applicable platform rules, Survival Games grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to:

download and install the relevant Game on devices that you own or control;
access and use the Game for lawful, personal and non-commercial entertainment; and
use online features made available for that Game, subject to their availability and applicable conditions.

The Games are licensed, not sold. You receive no ownership interest in a Game, its software or its content.

The licence does not include any right to obtain source code, operate a commercial service using the Game or use Survival Games’ intellectual property except as expressly permitted by this EULA.

6. Licence restrictions

Except where applicable law expressly permits an activity and does not allow it to be restricted, you must not:

copy a Game, except for copies automatically created as part of permitted installation or backup;
sell, rent, lease, sublicense, distribute, assign or otherwise transfer a Game or the licence granted under this EULA;
modify, translate, adapt, reverse engineer, decompile, disassemble, derive source code from or create derivative works of a Game or its server software;
remove or alter copyright, trade mark, attribution, security or proprietary notices;
bypass or interfere with purchase, subscription, entitlement, advertising, security, rate-limit, anti-cheat or anti-fraud mechanisms;
use cheats, bots, exploits, automation, unauthorised software or modified clients;
access or use a Game in a way that damages, disables, overloads or interferes with a Game, server, network or another player;
scrape, mine or access a Game through automated means in a manner that circumvents controls, places an unreasonable burden on our systems or violates applicable law;
use a Game or any related player identifier, account, virtual item or online feature for commercial purposes without our prior written permission; or
encourage or assist another person to do any of the above.

These restrictions do not limit any non-waivable right to reverse engineer or otherwise use software for interoperability, security research or another purpose expressly protected by applicable law.

7. Player identifiers and online features

Some Games may create a player or installation identifier without requiring a general Survival Games account. Multiplayer Games may use nicknames, rooms, sessions, shared worlds, leaderboards and other server-backed features.

You must keep credentials and player identifiers under your control secure. You are responsible for activity performed using identifiers you control, except to the extent that the activity results from our failure to use reasonable care.

You should notify us promptly if you suspect unauthorised access.

Single-player progress may be stored locally on your device. Unless a Game expressly provides a backup or cloud-save feature, uninstalling the Game, clearing local data or changing devices may permanently remove progress.

8. Purchases, subscriptions and virtual items

A Game may offer one-time purchases, subscriptions, free trials, virtual currency, consumables, non-consumable items or other digital features.

Purchases are processed by the seller and payment provider identified before confirmation, such as Apple, Google, Aghanim or another authorised provider. Their payment, cancellation and refund procedures also apply.

Virtual currency and virtual items:

are licensed digital features and are not money or tangible property;
have no cash value and cannot be redeemed for cash unless applicable law expressly requires otherwise;
may be used only within authorised Game or Hub features;
cannot be sold or transferred outside authorised features;
may be adjusted where reasonably necessary for gameplay balancing, security, legal compliance or continued operation of the service; and
remain subject to mandatory consumer rights and remedies.

We will not remove purchased value arbitrarily. If paid value is lost because of a verified technical failure for which we are responsible, we will provide the remedy required by applicable law and the relevant payment-provider rules.

Further conditions concerning subscriptions, trials, refunds, virtual items and randomised rewards are set out in the Terms of Use and on the applicable purchase screen.

9. Updates and technical requirements

We may provide updates, patches, bug fixes or new versions of a Game. An update may be required for security, compatibility or continued access to online features.

Where allowed by your device and platform settings, updates may download or install automatically. Some updates may change features, balancing, content or technical requirements.

We do not guarantee that every Game or future update will remain compatible with every device, operating-system version, network or third-party service. This does not affect any mandatory obligation to supply updates or maintain conformity under applicable consumer law.

You are responsible for compatible equipment, internet access and any network or data charges imposed by your service provider.

10. Availability and service changes

Games and online features may occasionally be unavailable because of maintenance, technical failures, security incidents or circumstances outside our reasonable control.

We may modify, suspend or discontinue a Game or online feature for legitimate product, technical, security, legal or commercial reasons.

Where reasonably practicable, we will give advance notice of material discontinuation affecting paid ongoing access and provide any refund, replacement, continued access or other remedy required by applicable law.

11. Player Content

Some Games may allow you to submit or display a nickname, room name, shared world, communication, leaderboard entry or other material (“Player Content”).

You retain rights you hold in original Player Content. You grant Survival Games a worldwide, non-exclusive and royalty-free licence to host, reproduce, transmit, display, moderate and remove Player Content only as reasonably necessary to:

operate and provide the relevant feature;
make Player Content available to users you choose to interact with;
maintain security and multiplayer integrity;
investigate reports or suspected violations; and
enforce this EULA, the Terms of Use or applicable law.

The licence ends when the relevant Player Content is deleted, except where continued retention is reasonably necessary for backup cycles, security, evidence preservation, legal compliance or the establishment, exercise or defence of legal claims.

Player conduct and content restrictions are described in the Terms of Use.

12. Intellectual property

The Games and their software, code, interface, artwork, audio, music, text, characters, worlds, designs, virtual items, trade marks and other content are owned by or licensed to Survival Games and are protected by intellectual-property laws.

All rights not expressly granted under this EULA are reserved.

Third-party names, trade marks and content remain the property of their respective owners. No licence to use a trade mark is granted except as necessary for ordinary use of the Games.

13. Third-party services

Games may contain links to or integrate services provided by Apple, Google, Aghanim, advertising providers, social-login providers, social networks or other third parties.

Third-party services are governed by their own terms and privacy notices. Survival Games is not responsible for a third party’s independent service, content or conduct.

Nothing in this section excludes responsibility that cannot lawfully be excluded, including responsibility for services or content that Survival Games is legally required to provide.

14. Privacy

Our Privacy Policy explains the personal data processed through the Games, including device and app information, gameplay events, diagnostics, attribution, advertising, push notifications, purchases, support and multiplayer features.

15. Suspension and termination

You may terminate this EULA at any time by uninstalling the Game and stopping its use.

We may suspend or terminate your online access or this licence if:

you materially or repeatedly breach this EULA or the Terms of Use;
you use cheats, commit fraud or interfere with security;
you infringe another person’s rights;
you fail to pay an amount properly due;
your conduct creates a material safety or security risk; or
suspension or termination is reasonably necessary to comply with law.

Where appropriate and legally required, we will consider the seriousness, recurrence and impact of the conduct and may provide notice or an opportunity to appeal. Immediate action may be taken for urgent security, fraud, legal or safety risks.

When this EULA terminates, you must stop using and uninstall the affected Game. Provisions that by their nature should continue after termination—including intellectual-property, liability and dispute provisions—will continue to apply.

Termination of this EULA does not automatically cancel a subscription. Subscriptions must be cancelled through the provider used to purchase them.

16. Consumer rights, warranties and disclaimers

Nothing in this EULA excludes or limits a warranty, guarantee, remedy or statutory consumer right that cannot lawfully be excluded or limited.

Subject to those mandatory rights, the Games and online features are provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation, compatibility with every device or correction of every defect.

Any disclaimer in this EULA applies only to the fullest extent permitted by applicable law.

17. Liability

Nothing in this EULA limits or excludes liability for:

death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
any liability that cannot lawfully be excluded; or
violation of mandatory consumer rights.

For consumers, we are responsible for foreseeable loss or damage caused by our breach of this EULA or failure to use reasonable care and skill.

We are not responsible for:

loss or damage that was not reasonably foreseeable;
business losses arising from personal, non-commercial use;
damage reasonably avoidable by applying an available update, following reasonable instructions or using an available backup; or
failures caused solely by an unaffiliated third-party platform, network or service outside our reasonable control.

Nothing in this section affects remedies available under applicable consumer law.

18. Governing law and disputes

This EULA is governed by the laws of England and Wales.

If you are a consumer, you retain the mandatory protections of the country in which you habitually reside. You may bring proceedings in England and Wales or in your home jurisdiction where applicable mandatory law gives you that right.

Before filing a claim, you may contact support@survivalgamesstudio.com so that we can attempt to resolve the matter informally. This does not suspend a limitation period or prevent either party from seeking urgent relief.

This EULA does not require arbitration, waive a right to bring an eligible claim before a court or require a consumer to waive class or collective rights where such a requirement would be unlawful.

19. Apple App Store terms

If you obtained a Game through Apple’s App Store:

this EULA is between you and Survival Games, not Apple;
Survival Games, not Apple, is responsible for the Game and its content;
Apple has no obligation to provide maintenance or support for the Game;
if the Game fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price paid for the Game, if any; to the maximum extent permitted by law, Apple has no other warranty obligation;
Survival Games is responsible for addressing claims relating to the Game or its possession or use, including product-liability, legal-compliance and consumer-protection claims;
Survival Games is responsible for the investigation, defence, settlement and discharge of third-party intellectual-property claims relating to the Game;
you represent that you are not located in a country subject to a United States Government embargo or designated as supporting terrorism and that you are not listed on a prohibited or restricted parties list;
you must comply with applicable third-party agreement terms; and
Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it after your acceptance of this EULA.

20. Google Play terms

If you obtained a Game through Google Play, this EULA is between you and Survival Games. Google is not responsible for providing, maintaining or supporting the Game.

Your use of Google Play and purchases made through Google Play are also subject to Google Play’s terms. Refunds, cancellation, subscription management and restoration are handled through applicable Google Play procedures, without limiting mandatory consumer rights.

21. Changes to this EULA

We may update this EULA for legal, security, technical or product reasons.

If a change materially affects existing rights or obligations, we will provide reasonable advance notice where required. A change will not retroactively remove an accrued mandatory right.

If applicable law requires renewed consent to a material change, the change will not apply until that consent has been obtained.

The effective date at the beginning of this EULA identifies the current version.

22. General provisions

Assignment. You may not transfer this licence except where applicable law expressly permits. We may transfer this EULA as part of a merger, reorganisation, financing or sale, provided that mandatory rights are not reduced.

Severability. If a provision is found unlawful or unenforceable, it will apply to the maximum lawful extent and the remainder of the EULA will continue.

No waiver. A delay in exercising a right does not waive that right.

Language. The English version controls to the extent permitted by law. A translation is provided for convenience unless local law requires otherwise.

Entire agreement. For licensing matters, this EULA, the Terms of Use, applicable purchase conditions and mandatory platform terms constitute the agreement between you and Survival Games. If there is a conflict, the priority rules in section 3 apply. Nothing excludes liability for fraud or overrides mandatory law.
